Legal Associate: Employment

We’re looking for a Legal Associate to join us on our mission to solve chaos in international real estate markets.

CASAFARI is the leading real estate data platform in Europe. With operations in Portugal, Spain, France, and Italy, the company has grown exponentially supported by 200 employees of, at least, 25 nationalities.

We started CASAFARI with a mission to organise the real estate market into an efficient data-powered ecosystem to enable and accelerate deals through a transparent and safe B2B platform. CASAFARI isn’t just another data aggregator: it's an entire operating system that powers real estate agents in real-time, removing asymmetry of knowledge, accelerating transactions and opening up new opportunities for iBuyers, property developers, investors and Q-commerce operators and beyond to reach their investment objectives.

Your Role

  • Lead the Employment Department within the Legal Team (+ ability to expand and build a larger employment team) working actively in a wide variety of Employment law issues, namely:
  • Day-to-day HR issues (drafting of various types of contracts, agreements);
  • Track and monitor employment contract deadlines and work to improve the contract management process.
  • Draft and implement necessary internal policies and guidelines applicable to all CASAFARI employees across the various jurisdictions (Remote Work Protocols, Leave Policies, Health and Safety, etc) + upload the latter  in the Company’s internal database so employees can self-serve;
  • Conduct disciplinary procedures, dismissal and redundancies processes.
  • Draft employee benefit schemes such as, stock option plans and other incentive schemes.
  • Working and acting as the point of contact with external parties to resolve International mobility issues.
  • Liaising with public entities (i.e. Portuguese Tax Authorities and Social Security) to resolve any employment issues (e.g. obtainment of NIF/NISS)
  • Coordinate and act as the main point of contact with law firms across the company’s various jurisdictions in the EU, to support with the content and implementation of all employment-related issues.
  • Partnering with the People Team to build efficient processes to maintain compliance with EU employment laws and regulations.
  • You will work closely with and report directly to the Legal Counsel and independently, advise our C-Level as well as our People Team on all topics of employment law as well as related legal areas.
  • Balance your legal advice with the need of a fast-growing, dynamic company for tangible, pragmatic advice. You are expected to proactively identify current or future challenges and issues.
  • Keeping up to date with new developments in employment legislation.

Requirements

  • Recognized law degree and member of the Portuguese Bar is a plus
  • Practical knowledge in the field of Portuguese employment law is mandatory
  • 3+ years of legal experience (preferably working in-house) in multi-jurisdictional employment matters
  • Experience in employment law matters of other non-Portuguese jurisdictions is not required. However, you are expected to obtain a basic proficiency in employment law advice related to non-Portuguese European jurisdictions (with external legal counsel support);
  • Good analytical, communication and interpersonal skills
  • With a hands-on mentality and the ability to independently identify and assess risks, you are able to work out practical solutions, support implementation in a pragmatic and business-oriented manner.

It will be needed a good command of English and following some extra points, from the Job Description above

  • In a Day to day basis: Been the point for contract for all employees regarding legal employment matters.
  • Lead employment matters within current Legal Team
  • Work with People Team in the recruitment process
  • Work with any third-party providers for international mobility issues that may arise + with Portuguese public entities for the request of any necessary NIF/NISS
  • Elaborate employment contracts in PT
  • Liaise and be the point of contact with our current Service Providers i.e. Remote to provide assistance in the employment of foreign workers
  • Maintain up to date the current contract monitoring + automate the current process for an effective monitor of all employees’ contracts.
  • Assist in any disciplinary procedures, dismissals, redundancies processes etc.
  • Draft any other ancillary employment documentation i.e. Stock option plans, addendums, necessary forms, declarations, etc.

Short-Term:

  • Draft applicable necessary internal policies/guidelines (remote work guidelines, health, and safety at the office/home) - so employees can self-serve
  • Work with the People Team to build efficient processes to maintain compliance with EU employment laws and regulations - padornizar all leaves within all jurisdictions

Long-term:

  • Act as point of contact with Law Firms to help with all employment matters as we expand to other jurisdictions (Spain, UKR, France, Italy, Germany)
  • Responsible for leading the projects of transferring all employees under Remote/SA - contracts when the time comes

Competencies:

  • 3-5 years working in a Law Firm or in-house (preferably in a start-up, ideally)
  • Experience in employment law in PT - mandatory
  • Experience in employment law matters of other non-Portuguese jurisdictions is not required. However, it is expected to obtain a basic proficiency in employment law advice related to non-Portuguese European jurisdictions (with external legal counsel support);
  • Comfortable working on jurisdictional issues (having to liaise with law firms from different jurisdictions)
  • Comfortable with leading all employment matters and with the possibility to grow the employment law department.
